eBud Inc. Terms of Service
My registration affirms and certifies that I am not a law enforcement agent or official, nor am I associated with any law enforcement agency. I understand this statement applies to me even if I am operating under cover of a false identity, through an informant or as an informant, or any other device to conceal my identity and/or affiliation with any government agency. I personally accept full legal civil responsibility for any legal action that may arise as the direct or indirect result of my use of this website. I understand this means I may be liable to civil prosecution for monetary damages arising out of my use of this website and/or any information or material obtained from it.
Terms of Service Rules: (added 12/21/2006)
1. You may not harm or exploit minors in any way. Use of the eBud Inc. software or site related services to harm or exploit minors in any way is not allowed and in violation of the law. The eBud Inc. website is restricted to use by users eighteen (18) and older. The eBud Inc. site related services may not be used by any user under the age of thirteen (13). The eBud Inc. site related services may not be used by users between the ages of thirteen (13) and eighteen (18) without adult supervision.
2. You may not use eBud Inc. for illegal purposes. eBud Inc. software and site related services may not be used for illegal purposes or to support illegal activities. eBud Inc. reserves the right to cooperate with legal authorities, and/or any injured third parties in the investigation of any criminal activity.
6. Impersonating a eBud Inc. employee is absolutely forbidden. eBud Inc. employees will never ask you for your logon, password, or credit card.
7. You may not use eBud Inc. web services or eBud Inc. software to spam others. Spam includes sending many identical unsolicited messages to others, or creating eBud Inc. profiles in order to send traffic to a specific website or affiliate program without eBud Inc.'s express written permission.
8. Copyright or trademark infringement is absolutely forbidden. You may not upload or transmit any material that infringes on any copyright, trademark, patent, or any proprietary rights of any party. To report trademark or copyright infringement please visit our contact page which can be found at http://www.ebudmarketplace.com under the link "contact."
9. Accessing unauthorized eBud Inc. accounts and services is absolutely forbidden. You may not attempt to logon to accounts which are not yours.
10. You may not use the eBud Inc. software or site related services to collect or attempt to collect personal information about third parties without their knowledge and consent.
11. You may not use the eBud Inc. website or site related services to commit or attempt to commit fraud. You may not knowingly mislead others with the intent that the other party will act on it.
12. In order to use the eBud Inc. service, eBud Inc. will grant you a User ID, Password after your application is approved. You are solely responsible for maintaining the confidentiality of your User ID and Password. You may not share your logon and password with others so they can access your account. You are responsible and liable for all activities conducted through your User ID, Password and Account, even if this occurs without your permission. If a child less than thirteen (13) years of age has access to your computer, do not save your eBud Inc. password on your computer. Not saving your password will help to restrict children and any other unauthorized user from using your account. In addition, we strongly recommend that you check regularly to see if any new, unauthorized accounts have been created under your eBud Inc. account.
13. You may not act in a way that impedes others from communicating through video chat rooms, our eBud Inc. directories, or with the eBud Inc. software.
14. You may not interfere with or disrupt the eBud Inc. servers or services in any manner whatsoever. Doing so may be a violation of Federal law.
15. YOU ACKNOWLEDGE THAT YOUR eBud Inc. PROFILE IS COMPLETELY CONFIDENTIAL AND MAY NOT BE USED BY ANYONE ELSE. THE eBud Inc. SITE RELATED SERVICES AND/OR ADS ARE NOT SUITABLE FOR USERS UNDER THE AGE OF EIGHTEEN (18) YEARS OF AGE. eBud Inc. HAS TAKEN EVERY REASONABLE STEP TO INSURE THAT SUCH AREAS ARE NOT AVAILABLE TO USERS UNDER THE AGE OF EIGHTEEN (18) YEARS OF AGE. IF YOU ARE UNDER THE AGE OF EIGHTEEN (18) YEARS OF AGE AND SOMEHOW DO ACCESS A SITE RELATED SERVICE YOU MUST EXIT SUCH SERVICE IMMEDIATELY, AND NOTIFY eBud Inc. OF YOUR ACCESS. eBud Inc. RESERVES THE RIGHT TO REQUEST FURTHER INFORMATION FROM YOU IN AN EFFORT TO FURTHER ASSURE SUCH SITE RELATED SERVICE OR ADS CANNOT BE ACCESSED BY USERS UNDER THE AGE OF EIGHTEEN (18).
17. You may not use eBud Inc. site related services to transmit viruses or any other malicious programs. Doing so may be a violation of Federal law.
18. You may not share your eBud Inc. Account
with others. Please keep your serial ACCOUNT private. If more than one person tries to use your login at the same time you will both be disconnected from the eBud Inc. service and be contacted immediately. If you share your login account information with others eBud Inc. can't and won't reissue you another account and you may be prosecuted by the state if you are responsible for allowing anyone to use your account.
19. You may not use the eBud Inc. website or site related services to disparage or damage the reputation of eBud Inc. or eBud Inc. employees, contractors, agents, officers or directors.
20. If you do not logon to eBud Inc. for 6 months your account may be deactivated.
21. Use of eBud Inc. is solely for your personal, non-commercial use only. You may not use the eBud Inc. software or site related services to generate income in any manner. eBud Inc. shall not be liable to any third party that creates or implements any helper application software for use with eBud Inc.. The sole exception to this clause is for paid advertisers subject to additional terms and conditions provided to them upon application for advertising services.
22. eBud Inc. reserves the right to modify or change the eBud Inc. software and site related services without notice. eBud Inc. shall not be liable to you or any third party for changes in our software or site related services.
23. These Terms of Service will be interpreted and governed by the laws of the State you reside in. You agree that any legal dispute involving eBud Inc. software and/or site related services must take place in State or Federal courts in Jefferson County, Colorado. You agree to waive any objection to personal jurisdiction, and agree that venue shall be in Jefferson County, Colorado. eBud Inc.'s liability to you for any cause whatsoever, no matter the form of the action, will at all times be limited to the amount paid, if any, by you to eBud Inc. for products and services during your membership.
24. These Terms of Service, along with any applicable eBud Inc. software license and agreement, constitute the entire agreement between the parties and supersede any prior written or oral understanding or agreements.
25. eBud Inc. reserves the right to remove or disable any profiles that in eBud Inc.'s opinion violate any of these Terms of Service, or any term of the accompanying license and/or agreement.

Governing Law
These TOS shall be governed by and construed in accordance with the laws of the State you reside in, without giving effect to any principles of conflicts of law. EBUD ONLINE MARIJUANA DISCLAIMER
(According to the DEA)
The actual physical location of the pharmacy which purchases, stores and dispenses controlled substances pursuant to prescription orders processed by the Internet site must be registered with DEA.
The website itself would not require a separate registration unless it is the same physical location, since the website does not store or dispense controlled substances.
For example, some Internet pharmacies maintain a central pharmacy warehouse site and offices where prescriptions are verified and substances shipped; this location must be registered with DEA as a retail pharmacy.
Other Internet sites allow patients to pick up their prescriptions for controlled substances from a local pharmacy; these local pharmacies must be registered with DEA. In this case, the Internet "pharmacy" has no obligations under DEA regulations because the responsibility for assuring compliance with DEA regulations rests with the actual pharmacy where the controlled substances are dispensed.

Also our website will not be assessable to the general public. Individual dispensary stores will only be assessable to their perspective clients. Patients will only be made available for viewing by invitation or request from participating dispensaries.
Currently we are only offering an online ordering system which provides optional pickup from the Dispensary or delivery from a courier service for Dispensary.
eBud.com is not an online pharmacy, nor are we a dispensary. We only provide a market place for licensed dispensaries to display products and provide an ordering system for their individual patients.
Futhermore are services are limited to advertising, marketing, web services and internet related services. We only represent the businesses listed on our website as a website hosting service by providing website space and an online ordering system, and at no point ever handle, distribute or sell any products whatsoever. We do not endorse or recommend any products, services published by our websites. We only supply supportive services to our clients as an independent agent and hold no responsibility as to the content of the website or the business represented.
